Director, Phil Howden BEng (Hons) CEng FICE FIStructE IMaPS received a Civil Procedure Rules, Part 35 Instruction as a Single Joint Expert to provide evidence in respect of a claim being made by a property owner regarding a defective domestic extension.

The Contractor had failed to inform the property owner that a Building Regulation application should have been made and the extension was constructed uncontrolled by a Building Regulation Body.

A dispute arose between the property owner and the contractor and following a Claim, the Court directed that a single joint expert be appointed.

Phil carried out a Structural Inspection together with intrusive investigations to expose the foundations of the extension. Among other matters, is was determined that the extension had not been adequately founded and was partly constructed off a previous conservatory slab.

Phil recommended that the extension was taken down and reconstructed off new foundations. The Claim was settled prior to any hearing.
